Permits & Scope

What remodeling work does not need a permit in California?

The short answer

Cosmetic work and like-for-like replacements within the existing layout often do not need a building permit in California, such as new cabinets, countertops, flooring, tile, paint and fixtures in their current locations. Rules vary by city, so check with your local building department. Moving walls, plumbing or gas, or adding circuits typically requires one.

The general idea is that replacing finishes and fixtures where they already are is treated differently from changing how a home is built. Swapping cabinets and countertops, replacing a vanity or toilet in the same spot, retiling a shower, installing new flooring, or painting usually falls into the first group. Each city sets its own rules, though, and some require permits for items others do not, so confirm locally before you start.

Work that typically requires a permit includes moving or removing walls, relocating drains, supply lines or gas lines, running new gas lines, adding new electrical circuits, widening doorways, cutting a slab for a curbless shower and building an attached patio cover. These changes affect structure, safety systems or the building envelope, which is why cities want plans reviewed and work inspected.

Legacy builds its projects around the first category. We keep our projects within the scope that does not require a building permit, and we tell you at the first visit if what you have in mind would need one. In many kitchens and bathrooms, keeping the layout gives you new cabinets, counters, tile, lighting and fixtures, and it keeps cost and schedule more predictable too.
