Permits & Scope

Do you need a permit for a kitchen remodel in California?

The short answer

Often not, if the kitchen keeps its existing layout. Like-for-like work such as new cabinets, countertops, backsplash, flooring and fixtures in the same locations often does not need a permit. Moving walls, relocating plumbing or gas, or adding new electrical circuits does, and that work is outside the projects Legacy takes on.

In California, building permits are issued by your city, or by the county in unincorporated areas, and each one sets its own rules. As a general rule, a permit is required when a remodel removes or moves walls, relocates the sink or other plumbing, runs or moves a gas line, or adds new electrical circuits. Replacing cabinets, countertops, tile, flooring, a faucet or a light fixture in the same place often does not. Because rules vary by city, it is worth confirming with your local building department for your specific plan.

Legacy Construction & Design builds kitchens within the existing layout. We keep our projects within the scope that does not require a building permit, and we tell you at the first visit if what you have in mind would need one. That means the sink, range, refrigerator and walls stay where they are, and the plumbing and electrical work happens in the existing locations. If your plans include moving the sink to an island or removing a wall, we say so plainly at the consultation so you can plan accordingly.

Staying in the existing layout is not as limiting as it sounds. New cabinets, a fresh countertop material, a better lighting plan, a new backsplash and continuous flooring can make a kitchen look and work completely differently. It also saves real money, since rerouting plumbing and moving walls are among the most expensive parts of any remodel, and it avoids the wait for plan review. A freestanding island without plumbing or new circuits is often a good way to add workspace.
